The Public-Private Partnership (PPP) Center in the Philippines during a public consultation at the Asian Development Bank (ADB) in Mandaluyong City, Philippines, has emphasized that the amendments to the 2022 Implementing Rules and Regulations (IRR) of the Build-Operate-Transfer (BOT) Law provide for resolving issues on financial viability and bankability of PPP projects and improving the PPP Program and process.
The proposed BOT Law IRR update aims to find the optimal balance of risk sharing between the government and the private sector and enable all parties to fulfill existing contractual obligations to PPP contracts. The amendments should also ensure transparency and accountability in the implementation of infrastructure projects.
The 2022 IRR of the BOT Law was approved by the government, subsequently published and entered into force on April 26, 2022. The National Economic and Development Authority (NEDA), the Department of Finance (DOF), the PPP Center of the Philippines and the Department of Energy participated in the public consultations.
