The National Civil Aviation Agency (ANAC) won a court ruling allowing it to continue revoking the concession of Viracopos airport in Campinas, currently controlled by Triunfo Participações e Investimentos, UTC, and Infraero.
Due to low passenger flow than projections, the concessionaire ABV SA is suffering a loss in term of revenues. ABV has invested 3 billion reais ($954 million) in a new terminal to serve projected 17.9 million passengers in 2016, but only had 9.3 million travelers.
But for currently bankrupted concessionaire ABV, the overrule decision to halt the process and stop collecting fines for failing to meet investment mandates is another blow.
The concessionaire, which had already manifested the intention to forfeit the airport and find a market solution, says it will appeal the decision. The company said 'The concession will be returned to the government and put up for auction again, ABV believes retendering the concession is the best alternative to maintain the quality and continuity of the services for users'
