Vietnam seeks market reactions for new PPP legislation

Vietnam's Ministry of Planning and Investment (MPI) has published substantial draft revisions to Decision 71 (covering Vietnam's PPP program) and the related PPP tender procedures in the draft Law on Public Procurement. MPI has been charged with revising Decision 71 and developing related PPP provisions in the draft Law on Public Procurement to reenergize Vietnam's PPP program.

Hogan Lovells has assisted MPI to significantly upgrade these regulations in a manner calculated to address issues that have to date hindered the development of PPP in Vietnam. These revised regulations are expected to go before the Prime Minister over the coming three months.

The MPI seeks comments from private sector players regarding these draft regulations in order to take into consideration private sector concerns regarding PPP in Vietnam and to ensure Vietnam's PPP approach will work for both the public and private sectors. This feedback will be very important to help the Government of Vietnam understand the private sector viewpoint as it finalizes these regulations.
