The State of Maranhão (Brasil) has enacted a new law on public-private partnerships (PPPs) and a new regulation on the Expresion of Interest procedure (EOI).
The Law No. 10,521 / 2016, of October 19, establishes the Public-Private Partnerships Program in Maranhão, and creates a Management Council and a Guarantor Fund. This law repeals the previous state legislation of 2008 and 2009.
The Management Council is composed of 6 members: Governor of the State (President); Secretary of State of Government (Vice); Secretary-Head of the Civil House; Secretary of State for Planning and Budget; Secretary of State for Finance; And Attorney General of the State.
The elaboration of an annual State Plan for Public-Private Partnerships will be one of the Governing Board's responsibilities. It will outline the objectives, define the government actions on PPPs and will justifiably present the Public-Private Partnership projects to be implemented By the state executive branch.
The law also created a Public-Private Partnerships Unit (PPP Unit), linked to the State Secretariat of Government, which will provide technical support to the Management Council.
The Municipality of Mauá, in the metropolitan region of São Paulo (Brazil), has signed a PPP contract for the provision of street lighting.
